1. Who we are, and agreement to these terms
The Service is operated by [entity name and address — to be completed before launch]. By installing the extension, creating an account, or using the website, you agree to these terms. If you don't agree, don't use the Service.
2. What the Service is (and isn't)
- The Service displays and organizes your own credit-card benefit data — credits, usage, reset dates, signup-bonus progress — captured on your device from bank websites you are signed in to.
- The Service is currently in private beta. Features may change, break, or be withdrawn while in beta.
- The Service is not financial, legal, or tax advice, and it is not a substitute for your issuer's own records. Benefit amounts, dates, and statuses are parsed from issuer data and may be incomplete, delayed, or wrong. Always verify with your issuer before making decisions (e.g., canceling a card, timing a purchase against a credit).
- Perkival is an independent tool. It is not affiliated with, endorsed by, or sponsored by JPMorgan Chase. JPMorgan Chase and Chase are trademarks used only for identification.
3. Your bank relationship stays yours
- Our servers never ask for or store your bank credentials, and Perkival never logs in to your bank as you. Capture happens on your device, using the session you opened yourself.
- Your agreements with your card issuers — including their website terms — are between you and them. Some issuer terms restrict automated access to their sites; the trust & security page explains candidly how Perkival works, how it throttles itself, and the theoretical risk that an issuer could object or flag account activity. You decide whether to use the Service with a given issuer, and you use it at your own risk in that respect.
4. Your account and your data
- A Perkival account is required to use the Service. Keep your sign-in method secure; you are responsible for activity under your account.
- Your data remains yours. You can export it (CSV or Excel) and delete your entire account at any time. Data handling is described in the privacy policy.
5. Acceptable use
You agree not to:
- use the Service on accounts you are not authorized to access;
- attempt to probe, overload, or interfere with the Service or with issuer websites through it;
- reverse the Service into a tool for harvesting other people's data;
- resell or white-label the Service without our written agreement.
6. Beta software — warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT BENEFIT DATA IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST CREDITS, MISSED BENEFITS, EXPIRED REWARDS, ISSUER ACTIONS ON YOUR ACCOUNTS, OR LOST PROFITS, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AND US $50. [Counsel: confirm cap and carve-outs by jurisdiction.]
8. Price
The private beta is free of charge. If we introduce paid plans, we will announce them, and continued use of any paid feature will require your explicit agreement — nothing converts to paid silently.
9. Termination
You can stop using the Service at any time; uninstalling the extension and deleting your account removes your relationship with us. We may suspend or terminate access for breach of these terms or to protect the Service, and we may discontinue the beta. Because your data is always exportable to CSV and Excel from the product, you can take it with you before the hosted service ends.
10. Changes to these terms
This is a draft and will change before launch (see the banner). Once in force, material changes will be announced in the product and on this page with a new effective date before they apply.
11. Governing law and contact
Governing law and venue: [to be determined with counsel]. Contact: [legal contact address — to be confirmed].
